The term “Premium Subscriber” refers to a user that has registered and subscribed to our web site and holds a current subscription at any of the Bronze, Silver, Gold, or Platinum subscription levels

The term “Registered User” refers to any user that has completed the registration process on the web site, but does not hold a current subscription

The term “Profile Holder” refers to any user that has a profile on our web site

The term “Agent” refers to any individual or entity that has registered on our web site in the capacity of agent or representing an agency

The term “Verified Agent” refers to any individual or entity that has registered on our web site in the capacity of agent and has subsequently been verified by StarsInMyEyes as being a bona fide commercial operation

The term “Credit Card Processor” refers to the secure third party credit card processing company we have selected to handle our credit card merchant services, Authorize.net

OUR SERVICE
Detailed information relating to all opportunities on our web site is accessible free-of-charge to all users, including visitors; however, information on how to apply for opportunities is only available to registered subscribers.

We accept no responsibility for the content of any opportunity that is featured on this web site and make no warranty, implied or otherwise, regarding the accuracy, reliability or validity of such information.

No Agent registered with us will have access to personal contact details of a Subscriber unless they have been granted Verified Agent status by us. In order to achieve Verified Agent status StarsInMyEyes must be satisfied that they are a professional and/or accredited organization. We encourage our users, however, to exercise caution and judgment in any internet communication with a party with whom you are unfamiliar. Again, under no circumstances can we be held responsible or liable for consequences that result from data that you elect to share with third parties through our web site

No personal contact information for any Subscriber will be made available to an Agent unless expressly permitted by the Subscriber. A Subscriber's telephone number(s) may be made available to a Verified Agent only if the Subscriber has enabled this via their profile control panel.

By registering with us, the User agrees that any personal data you provide may be used for the purposes of 1) providing services to you, 2) communicating with you from time-to-time regarding updates and enhancements to our products and services, and/or those of our industry partners, 3) to assist with StarsInMyEyes research or 4) to verify the User’s identity and/or eligibility to use our web site

CONTENT & COPYRIGHT

By accessing this site you agree not to copy, reproduce, republish or transmit content in any form either directly or indirectly to any other web site, user group, bulletin board, mailing list, server or other storage device. In the event that a user is determined to be in breach of these conditions we reserve the right to prevent further access to our web site by any means at their disposal including but not limited to the blocking of an IP address or addresses or address range and/or suspension of profile holder log-in privileges. In the event that a profile holder's log-in privileges are suspended the profile holder shall have the right to appeal this decision by submitting an email to abuse@starsinmyeyes.tv. In the event that a subscriber's log-in privileges are suspended, the subscriber shall not be entitled to any refund relative to the unused subscription period.

AGE RESTRICTIONS
We would like to encourage individuals of all ages to be able to benefit from our web site and services, however the Federal Trade Commission (FTC) has strict guidelines in place with which we must comply. Therefore we have put the following measures in place:

For those aged 18 years and older: No additional restrictions in the usage of the web site or in becoming a subscriber.

For those aged 13 years but younger than 18: You may directly subscribe to the web site, but you must obtain the consent of your parent, legal guardian, or the registered cardholder making payment in the use of a credit card for the purposes of getting a premium membership.

For those younger than 13 years of age: We do not accept registrations from anyone under the age of 13. Our system will prevent registrations where a date-of-birth calculates an age of less than 13 years. Entering an incorrect date-of-birth in order to circumnavigate this restriction will be considered a violation of these Terms & Conditions and result in immediate termination of registration and any related subscription.

PRICING & PAYMENT / CANCELLATIONS
Premium Subscriptions are billed automatically on a recurring basis dictated by the subscription type selected (Bronze - monthly, Silver - quarterly, Gold - bi-annually or Platinum - annually) and may be canceled by the subscriber at any time. Subscribers accept that subscription fees are payable in advance and that no refund will be given for unused subscription periods. In the event that a recurring payment is declined by a card issuer then we will re-apply for failed payments for up to 7 days but the subscriber's access will be suspended until such time as payment(s) are reinstated. Subscriptions may be canceled by a subscriber at any time but this MUST be done via the subscriber profile Control Panel using the UNSUBSCRIBE link. Our payment gateway automatically processes recurring billings in the early hours of the morning on the date they are due, therefore in order to ensure that no further payments are taken against a subscription, the unsubscribe process MUST be submitted no later than 10:00 PM US Central Time on the day before the next subscription payment is due. Cancellation requests submitted by email, via our support ticket system or via a voice mail message will NOT be accepted. In the event that a subscriber submits a cancellation request via their Control Panel which complies with the foregoing requirements and the subscription is not cancelled before another payment is taken we will issue a prompt refund of any charge made that is not justified.

PROMOTIONS AND PUBLICITY
From time-to-time we may run promotional campaigns whereby awards, incentives, prizes and/or similar may be offered to new users. By participating in a promotional campaign, users agree that a link to their profile may be used for promotional/marketing purposes.

MODIFICATIONS
We reserve the right to vary these Terms and Conditions from time-to-time and you accept that it is your responsibility to check our web site periodically in order to make yourself aware of any changes. Your continued use of the web site will be deemed to be an acceptance of the prevailing Terms and Conditions.

US LAW
These Terms and Conditions are under Georgia law and all parties submit to the exclusive jurisdiction of the Georgia Courts if there are any disputes between them of any kind. If any of these Terms or Conditions are held by any competent authority to be unlawful, invalid or unenforceable in whole or in part, then the validity of the other provisions of these Terms and Conditions and the remainder of the provision in question shall not be affected thereby and shall continue to be valid and enforceable to the fullest extent permitted by law.

ACCEPTABLE USE AND BREACH OF CONTRACT
You agree to access or use this web site only for its intended purpose, that being to market your talent, or seek employment opportunities or exposure for yourself in the entertainment industry.

Attempts to disrupt or damage this web site may result in civil or criminal liability. We will investigate such violations and may involve, and co-operate with, law enforcement authorities in order to prosecute those who are responsible for such violations.
If we find you to in breach of the contractual terms and conditions outlined herein, we may immediately suspend your account. Further, we may seek legal remedy if, in our sole discretion, the breach of conduct warrants further action. If you are determined to be at fault, you agree to any judgments found against plus recompense for any legal fees that we may incur during the process.
